Theo khoản 24, Điều 4 Luật Doanh nghiệp 2020, người quản lý doanh nghiệp được hiểu là người quản lý công ty và người quản lý doanh nghiệp tư nhân. Cụ thể, người quản lý doanh nghiệp bao gồm:

Thủ tục xin giấy phép lao động cho nhà quản lý cần những gì?
Trước hết, giấy phép lao động là gì?
Giấy phép lao động là văn bản pháp lý do cơ quan nhà nước có thẩm quyền của Việt Nam cấp, cho phép người lao động nước ngoài được làm việc hợp pháp tại Việt Nam trong một thời hạn nhất định và tại đúng vị trí công việc đã đăng ký.
Thủ tục xin Giấy phép lao động cho nhà quản lý người nước ngoài tại Việt Nam thường được thực hiện theo 02 bước như sau:
Bước 1: Xin công văn chấp thuận nhu cầu sử dụng lao động nước ngoài
Doanh nghiệp nộp hồ sơ đề nghị chấp thuận nhu cầu sử dụng người lao động nước ngoài tại cơ quan/đơn vị có thẩm quyền theo quy định.
Bước 2: Xin cấp giấy phép lao động
Sau khi được chấp thuận ở Bước 1, doanh nghiệp tiếp tục nộp hồ sơ đề nghị cấp giấy phép lao động cho nhà quản lý tại cơ quan có thẩm quyền cấp phép.
Hồ sơ cấp mới giấy phép lao động cho nhà quản lý gồm những gì?
Hồ sơ đề nghị cấp mới Giấy phép lao động cho nhà quản lý thường bao gồm các giấy tờ sau:

Văn bản đề nghị cấp Giấy phép lao động cho người lao động nước ngoài theo Mẫu số 11, ban hành kèm theo Phụ lục I Nghị định 152/2020/NĐ-CP

Văn bản xác nhận kinh nghiệm làm việc chứng minh người lao động là nhà quản lý/giám đốc điều hành, có thời hạn tối thiểu 03 năm

Văn bản chấp thuận doanh nghiệp được sử dụng lao động nước ngoài (kết quả của Bước 1)

Quyết định bổ nhiệm người lao động giữ chức danh nhà quản lý tương ứng

Điều lệ công ty (áp dụng trong một số trường hợp cụ thể) – 01 bản sao chứng thực
-
Giấy khám sức khỏe còn hiệu lực 12 tháng, được cấp tại bệnh viện/phòng khám đủ điều kiện theo quy định của Bộ Y tế (tại Việt Nam hoặc nước ngoài)

Phiếu lý lịch tư pháp Việt Nam hoặc văn bản xác nhận không có án tích do cơ quan có thẩm quyền cấp, thời hạn không quá 06 tháng tính đến ngày nộp hồ sơ

02 ảnh màu chụp trong vòng 06 tháng (kích thước 4cm x 6cm, chụp chính diện, đầu để trần, rõ mặt – rõ hai tai, không đeo kính, nền trắng)

Bản sao hộ chiếu hoặc giấy tờ có giá trị thay hộ chiếu còn hiệu lực theo quy định pháp luật (kèm visa Việt Nam còn thời hạn phù hợp để làm Giấy phép lao động)
Lưu ý quan trọng khi chuẩn bị hồ sơ
Các giấy tờ do cơ quan nước ngoài cấp như: bằng cấp, giấy xác nhận kinh nghiệm, văn bản xác nhận nhà quản lý, giấy khám sức khỏe, lý lịch tư pháp… bắt buộc phải được hợp pháp hóa lãnh sự và dịch công chứng sang tiếng Việt theo đúng quy định trước khi nộp hồ sơ.

Đối với doanh nghiệp hoạt động trong khu công nghiệp:
Thủ tục đề nghị cấp giấy phép lao động cho người nước ngoài được thực hiện tại Ban quản lý các Khu công nghiệp của tỉnh/thành phố nơi doanh nghiệp đặt trụ sở. -
Đối với doanh nghiệp hoạt động ngoài khu công nghiệp:
Hồ sơ đề nghị cấp Giấy phép lao động được nộp tại Sở lao động – Thương binh và Xã hội tỉnh, thành phố trực thuộc Trung ương.
Thời gian giải quyết hồ sơ
Trong trường hợp hồ sơ đầy đủ và hợp lệ, cơ quan có thẩm quyền sẽ trả kết quả trong khoảng từ 10 – 15 ngày làm việc, không bao gồm ngày nghỉ, lễ theo quy định.
