Người nước ngoài khi muốn nhập cảnh vào Việt Nam với các mục đích như làm việc, học tập, nghiên cứu, đầu tư… đều phải thực hiện thủ tục xin visa theo quy định (trừ trường hợp được miễn thị thực).
Vậy mỗi loại visa nhập cảnh Việt Nam có thời hạn bao lâu? Được phép nhập cảnh một lần hay nhiều lần? Và thời gian lưu trú tối đa cho từng loại visa được quy định như thế nào?
Thời hạn visa là gì?
Trước hết, cần hiểu rõ khái niệm thời hạn visa để tránh nhầm lẫn khi sử dụng.
Thời hạn visa là khoảng thời gian mà người nước ngoài được phép nhập cảnh, xuất cảnh và tạm trú hợp pháp tại quốc gia mà mình không mang quốc tịch. Thông tin về thời hạn này thường được thể hiện trực tiếp trên visa hoặc trên dấu xác nhận tạm trú do cơ quan có thẩm quyền đóng tại cửa khẩu, Đại sứ quán/Lãnh sự quán hoặc Cơ quan quản lý xuất nhập cảnh.
Người nước ngoài nhập cảnh vào Việt Nam với nhiều mục đích khác nhau như công tác, đầu tư, kinh doanh, du lịch, du học, làm việc… Theo quy định pháp luật Việt Nam, mỗi mục đích nhập cảnh sẽ tương ứng với một loại visa riêng. Vì vậy, mỗi loại visa sẽ có thời hạn hiệu lực, số lần nhập cảnh và thời gian tạm trú khác nhau.
Thời hạn thị thực vào việt nam
Theo quy định của Luật Xuất nhập cảnh, căn cứ vào mục đích nhập cảnh, mỗi đối tượng người nước ngoài sẽ được cấp loại visa với ký hiệu riêng và thời hạn tương ứng. Cụ thể:

Visa LS: Cấp cho luật sư nước ngoài hành nghề tại Việt Nam. Thời hạn tối đa 12 tháng; trường hợp đủ điều kiện có thể xin thẻ tạm trú với thời hạn lên đến 2 năm.

Visa DL: Cấp cho người nước ngoài nhập cảnh với mục đích du lịch, tham quan. Thời hạn tối đa 90 ngày; thời gian tạm trú mỗi lần nhập cảnh theo quy định cụ thể của từng trường hợp.

Visa ĐT (ĐT1, ĐT2, ĐT3, ĐT4): Cấp cho nhà đầu tư nước ngoài tại Việt Nam. Thời hạn phụ thuộc vào mức vốn góp và loại hình đầu tư; có thể được xem xét cấp thẻ tạm trú dài hạn theo quy định.

Visa DN (DN1, DN2): Cấp cho người nước ngoài làm việc với doanh nghiệp, tổ chức tại Việt Nam nhưng không thuộc diện lao động có giấy phép lao động. Thời hạn thường đến 12 tháng tùy trường hợp.

Visa LĐ (LĐ1, LĐ2): Cấp cho người nước ngoài làm việc hợp pháp tại Việt Nam. Thời hạn tối đa 12 tháng; có thể được cấp thẻ tạm trú lên đến 2 năm nếu đủ điều kiện.

Visa EV (E-visa): Thị thực điện tử, thời hạn theo quy định hiện hành và được cấp cho mục đích ngắn hạn.

Visa SQ: Cấp cho các trường hợp đặc biệt theo đề nghị của cơ quan có thẩm quyền; thời hạn không quá 30 ngày.

Visa HN: Cấp cho người nước ngoài tham dự hội nghị, hội thảo; thời hạn lưu trú tối đa 3 tháng.

Visa VR: Cấp cho người nước ngoài vào Việt Nam thăm thân hoặc giải quyết việc riêng; thời hạn không quá 6 tháng.

Các loại visa khác như NG1, NG2, NG3, NG4, LV1, LV2, NN1, NN2, NN3, DH, PV1, PV2, TT… có thời hạn theo từng nhóm đối tượng cụ thể và có thể được xem xét cấp thẻ tạm trú dài hạn nếu đáp ứng điều kiện.
Tùy từng trường hợp cụ thể, thời hạn visa, số lần nhập cảnh (một lần hoặc nhiều lần) và thời gian tạm trú sẽ khác nhau. Việc lựa chọn đúng loại visa ngay từ đầu sẽ giúp người nước ngoài và đơn vị bảo lãnh tránh được rủi ro pháp lý trong quá trình lưu trú tại Việt Nam.

Thời hạn visa được tính từ khi nào?
Thời hạn visa được tính kể từ ngày Cơ quan Quản lý xuất nhập cảnh hoặc cơ quan có thẩm quyền cấp thị thực ký và đóng dấu cấp visa cho người nước ngoài. Thông tin về ngày bắt đầu và ngày hết hạn sẽ được thể hiện trực tiếp trên visa hoặc hệ thống quản lý tương ứng.
Visa hết hạn có xuất cảnh được không?
Theo quy định, người nước ngoài khi xuất cảnh phải có hộ chiếu hoặc giấy thông hành hợp lệ và còn giá trị, kèm theo visa hoặc giấy tờ cư trú hợp pháp còn thời hạn. Trường hợp visa đã hết hạn mà chưa gia hạn hoặc xử lý theo quy định, người nước ngoài có thể bị xử phạt vi phạm hành chính trước khi làm thủ tục xuất cảnh.
Thời hạn visa thăm thân (TT)
Căn cứ Luật Nhập cảnh, xuất cảnh, cư trú của người nước ngoài tại Việt Nam, visa thăm thân có thời hạn tối đa không quá 12 tháng. Tuy nhiên, thời hạn visa luôn phải ngắn hơn thời hạn hộ chiếu hoặc giấy thông hành ít nhất 01 tháng theo quy định.
